Is the landlord required to pay for extermination?
Yes, as a general rule. Article 1854 of the Civil Code of Québec requires the landlord to deliver a dwelling in good habitable condition and maintain it as such throughout the lease (article 1910). An infestation impairs habitability: extermination costs fall to the landlord, even where the origin of the infestation cannot be established. A lease clause transferring that obligation to the tenant is without effect.
